The charges against a mom who was arrested after a Facebook video that showed her tossing around her one month old baby went viral have been dropped.

A Chattanooga judge made the decision on Tuesday, October 15.

Prosecutors say that while the video of Tybresha Sexton was disturbing, they didn’t believe they had enough evidence to prove neglect. Officers did say she smelled heavily of alcohol and was acting irrationally.

The child is now in the custody of her grandmother. Officials say she wasn’t hurt by the incident in question.
